Registrar may request evidence of situation of registered office

Section 50A gives the Registrar the power to request proof of a company's registered office address before registering a new company or recording a change of address.

• The Registrar can ask a company to provide evidence confirming where its registered office is actually situated.
• This power applies both when a new company is being incorporated and when an existing company notifies a change of registered office address.
• If the Registrar makes such a request, they will not register the company's constitution or record the address change until satisfactory evidence is provided.
• This power is in addition to the Registrar's existing general authority to require a statutory declaration under section 24(4).
