Language of claims

Section 714 deals with the language requirements for claims lodged with a liquidator in insolvency proceedings opened under the EU Insolvency Regulation, and defines the term "insolvency proceedings" as used in this chapter.

• The term "insolvency proceedings" in this chapter means proceedings opened under Article 3 of the EU Insolvency Regulation in the State, where those proceedings relate to a company.
• When a creditor lodges a claim with a liquidator, the claim may need to be translated if it is not written in the Irish or English language.
• The provision applies specifically to insolvency proceedings relating to companies, not to individuals or other entities.
• This section re-enacts Regulation 11 of the European Communities (Corporate Insolvency) Regulations 2002 (S.I. No. 333 of 2002).
