Transitional provision for companies struck off register before commencement of this Chapter

Section 744 deals with how the restoration rules in this Chapter apply to companies that were struck off the register under older companies legislation that predates the Companies Act 2014.

  • The restoration provisions in sections 736 to 743 apply equally to companies struck off under any former companies legislation before this Chapter came into force.
  • References in this Chapter to strike-off under Chapter 1 and to the date of dissolution are to be read as referring to the equivalent actions under the older legislation.
  • If a restoration application had already been made under the old legislation before this Chapter commenced, the old law continues to govern that application despite its repeal.
  • Any other necessary modifications are to be made when applying the current Chapter's provisions to companies struck off under former enactments.
