Supplementary rules, etc. by competent authority

Section 1383 empowers the Central Bank of Ireland, as the designated competent authority for transparency law, to make supplementary rules to support compliance with and supervision of transparency obligations for issuers of securities on regulated markets.

  • The Central Bank, as competent authority under the Transparency (Regulated Markets) Directive, may make rules imposing requirements on persons who have obligations under transparency law, including requiring them to follow specified procedures and use specified forms when providing information.
  • Rules may require persons to submit reports or make disclosures at specified times and in a specified manner to enable the Central Bank to effectively supervise activities covered by transparency law.
  • Rules must not contradict transparency law and must not require information to be provided to any person unless that requirement is reasonably related to the purposes of the Transparency (Regulated Markets) Directive.
  • Administrative sanctions available under transparency law for breaches of that law also apply to breaches of rules made under this section, and any rules previously in force under Section 22 of the Investment Funds, Companies and Miscellaneous Provisions Act 2006 continue in force as if made under this section.
