Interpretation (Chapter 2)

Section 1365 sets out the key definitions used throughout Chapter 2, which deals with market abuse, including the meaning of core EU regulations and directives, the scope of Irish market abuse law, and how terms shared with EU legislation should be interpreted.

  • The section defines the main EU instruments relevant to market abuse: the Market Abuse Regulation (EU No. 596/2014), the Commission Implementing Directive (EU 2015/2392) on reporting infringements, and the CSMA Directive (2014/57/EU) on criminal sanctions for market abuse.
  • "Irish market abuse law" is broadly defined to include domestic regulations made under the European Communities Act 1972, any other enactments giving effect to the EU instruments, directly applicable EU measures, and any supplementary or consequential measures adopted by the State.
  • Where a word or expression appears both in this Chapter and in the Market Abuse Regulation or either Directive, it carries the same meaning as in the EU instrument unless the Chapter indicates otherwise or Irish market abuse law provides a different definition.
  • "Minister" in this Chapter means the Minister for Finance.
