Notice of disclosure order

Section 812 sets out the notification requirements that must be followed when a disclosure order has been made in respect of a company's shares or debentures.

  • The applicant for a disclosure order must send a prescribed notice and a copy of the order to the company concerned, the Registrar, any non-resident registered holder the court considers should be notified, and any other person the court directs.
  • The notice must be sent by registered post within seven days of the order being made.
  • The applicant must also publish notice of the order in Iris OifigiΓΊil (the Official Irish Gazette) within seven days, replacing the former requirement to advertise in two local daily newspapers.
  • Where a non-resident registered holder must be notified, the notice is sent to their last address on file with the Registrar; if no address exists, sending the notice to the Registrar itself satisfies the requirement.
