Director may present petition for winding up following consideration of report

Section 761 deals with the power of the Corporate Enforcement Authority to petition the court to wind up a company on the grounds that it is just and equitable to do so, based on inspector reports or other information obtained in the course of its functions.

  • The Corporate Enforcement Authority may petition the court to wind up a body corporate where it considers it just and equitable to do so.
  • The petition may be based on a report from court-appointed inspectors who investigated the company's affairs.
  • The petition may also be based on any information or documents obtained by the Authority in the performance of any of its functions, not limited to those under Part 13.
  • This broad scope ensures the Authority can rely on evidence gathered through various means, including company registers, bankers' books evidence, and information volunteered by witnesses.
