Information on composition of board of directors by reference to gender

Section 888B provides a voluntary mechanism for companies to report the gender composition of their board of directors when filing their annual return, and sets out how that information is handled by the Registrar and the Minister.

  • Companies may voluntarily submit gender composition data about their board of directors to the Registrar in a prescribed form when delivering their annual return
  • The Registrar must pass the submitted information to the Minister, but must first strip out any details that could identify a specific individual or company
  • The Minister may publish the anonymised gender composition data in whatever form and manner they consider appropriate
  • Gender composition information submitted under this section does not legally form part of the company's annual return
