Process adviser to give notice of appointment

Section 558J sets out the notification requirements that must be followed when a process adviser is appointed for an eligible small or micro company under the rescue process.

• The process adviser must notify the Registrar, file documents with the relevant court, and arrange publication in Iris Oifigiúil within 2 working days of the resolution appointing them.
• The company's directors must post a prominent notice of the appointment on any company website within 48 hours of the resolution, and keep it there throughout the rescue period.
• The process adviser must retain records and supporting evidence showing how they arranged the publication in Iris Oifigiúil.
• Failure by any person to comply with these notification requirements is a category 3 offence.
