Court may grant restricted person relief from restrictions

Section 822 allows a person who has been restricted under the Companies Act to apply to the court for full or partial relief from those restrictions, subject to notice requirements and the court's discretion.

  • A restricted person may apply to the court for full or partial relief from a restriction declaration or a related order, and the court may grant relief if it considers it just and equitable to do so.
  • The applicant must give at least 14 days' written notice of their intention to apply to both the Corporate Enforcement Authority and the liquidator of the insolvent company whose winding up led to the restriction.
  • On receiving that notice, the liquidator must promptly inform all known creditors and contributories of the company, and failure to do so is a category 3 offence.
  • At the hearing, the Corporate Enforcement Authority, the liquidator, and any creditor or contributory of the company are entitled to appear and give evidence.
