Court may give directions in relation to investigation

Section 749 empowers the court to issue directions to an inspector or any other person during the course of a court-appointed investigation, with the overarching aim of ensuring the investigation is conducted as quickly and cost-effectively as possible.

  • The court may issue directions at any time during an investigation it has initiated under section 747 or section 748.
  • Directions may be given to the inspector or to any other relevant person involved in or connected with the investigation.
  • The court has broad discretion to issue whatever directions it considers necessary or appropriate in the circumstances.
  • A key objective of these directions is to ensure the investigation is carried out as quickly and inexpensively as possible.
