Process adviser's duty to seek provision of email addresses

Section 558I requires a process adviser, once appointed to assist an eligible small or micro company through a rescue process, to promptly contact all relevant stakeholders to collect email addresses for future communications.

  • The process adviser must write to employees, members, creditors, the Revenue Commissioners and any other prescribed persons as soon as practicable after appointment, requesting an email address for ongoing communications.
  • Each recipient must be informed that if they do not supply an email address, all future notices and documents will be sent to them by post.
  • The initial notice itself should be sent by email where the process adviser already has the person's email address, or otherwise by post.
  • The process adviser must retain records and supporting evidence of how each notice was delivered.
