Certificate evidence

Section 883 sets out the rules under which certificates signed by designated officers can be used as evidence in legal proceedings, without the officer needing to attend court in person.

  • A certificate signed by an appropriate officer, based on a review of records, is accepted as proof in legal proceedings unless contrary evidence is produced β€” covering matters such as whether items were received, notices issued or given, documents posted, or filings made.
  • A posted notice is presumed to have been received three days after the date of posting.
  • The certificate is admissible in court without needing to prove the officer's signature or authority to sign.
  • An "appropriate officer" includes the Minister or the Minister's officers, the Corporate Enforcement Authority or its officers, inspectors, the Registrar or authorised persons, and designated persons within the Central Bank.
