Jurisdiction to wind up companies and rules of court

Section 564 establishes that the court has jurisdiction to wind up a company and sets out the framework for updating court rules to align with the winding-up provisions of the Act.

• The court has jurisdiction to wind up a company.
• The Superior Courts Rules Committee holds the rule-making authority to regulate court practice and procedure in winding-up matters, drawing on powers under the Courts of Justice Acts of 1924 and 1936.
• Following the passing of the Act, existing court rules on windings up must be updated to conform with Part 11, including the removal of winding-up functions previously assigned to the court officer known as "the Examiner".
• The requirement to update specific rules does not limit the broader exercise of the rule-making authority for any purpose of the Act or otherwise.
