Procedure on application for disclosure order

Section 802 sets out the procedural requirements that must be followed when applying to the court for a disclosure order regarding a company's shares or debentures, including notice periods and rights of affected parties.

  • At least 10 days' notice must be given to both the company whose shares or debentures are concerned and the person to whom the order will be directed.
  • If the applicant is also seeking a supplemental order under section 809 relating to a share acquisition agreement, at least 10 days' notice must also be given to the person that order will be directed to.
  • The court may require the applicant to serve notice of the application on any additional persons it specifies.
  • Every person who has been notified of the application is entitled to appear at the hearing and present evidence.
