Miscellaneous provisions relating to disqualification by court order

Section 845 deals with various procedural and practical matters that apply when a court is asked to make a disqualification order against a person.

• Anyone applying for a disqualification order must give the person concerned at least 10 days' notice before making the application.
• A disqualification order can be based on matters other than criminal convictions, even if those same matters could lead to criminal charges against the person.
• If the court considers that full disqualification is not warranted, it may instead impose a restriction declaration under section 819 as an alternative.
• These provisions ensure fairness by requiring advance notice and giving the court flexibility in the outcome it imposes.
