Extension of time for registration of charges and rectification of register

Section 417 deals with the court's power to extend the deadline for registering charges and to correct errors or omissions in the charges register.

  • The court may extend the registration deadline or rectify errors where a failure to register on time, or an omission or misstatement, was accidental, due to inadvertence, or arose from some other sufficient cause.
  • Relief may also be granted where the omission or misstatement does not prejudice the position of creditors or shareholders of the company, or where it is otherwise just and equitable to do so.
  • The court may impose whatever terms and conditions it considers fair and appropriate when granting an extension of time or ordering rectification of the register.
  • An application for this relief may be made by the company itself or by any other person with an interest in the matter.
