Power of Authority to obtain information

Section 735 grants the Corporate Enforcement Authority the power to require directors of a company that has been involuntarily struck off the register to produce a statement of affairs, and provides for court enforcement and penalties for non-compliance.

• Where a company has been involuntarily struck off the register, the Corporate Enforcement Authority may require the directors to produce a verified statement of affairs
• The statement must include details of assets, debts, liabilities, creditors, and securities as at the date of dissolution, and must be sworn by affidavit
• The Authority may apply to court to compel any person who submitted the statement to appear and answer questions under oath about its contents
• Failure to produce the statement of affairs within the specified deadline is a category 3 criminal offence
