Public notice in case of voluntary strike off

Section 732 sets out the public notice requirements that the Registrar must follow when a company applies to be voluntarily struck off the register, including the content of the notice, the objection process, and the company's right to cancel the strike-off.

  • Once a valid voluntary strike-off application is received, the Registrar must promptly publish a notice in the CRO Gazette announcing the intention to strike the company off the register.
  • The notice must state that the company has applied to be struck off, invite objections (limited to the ground that the conditions for voluntary strike-off have not been met), and specify the deadline for raising objections.
  • The objection period runs for 90 days from the date the notice is published, and if no valid objection or cancellation request is received within that time, the Registrar may proceed to strike the company off and dissolve it.
  • The company itself may cancel the strike-off process at any time within the 90-day period by delivering a formal notice in the prescribed form to the Registrar.
