Director may direct convening of meetings

Section 679 gives the Corporate Enforcement Authority power to direct a liquidator to convene or reconvene meetings that are required under Part 11 of the Act but have not been held on time or in the proper manner.

  • Where a required meeting has not been held within the required timeframe or in the required manner, the Authority may direct the liquidator to convene or reconvene that meeting.
  • The Authority may specify the procedures for convening and holding the meeting, the matters to be dealt with, and the time and location of the meeting.
  • The Authority, or its authorised representative, has the right to attend any meeting convened or reconvened under such a direction.
  • A liquidator who fails to comply with such a direction commits a category 3 offence.
