Notification that receiver has been appointed

Section 429 sets out the requirements for notifying those dealing with a company that a receiver has been appointed, including what statements must appear on business documents, websites, and emails.

  • All invoices, orders for goods, and business letters bearing the company's name must state that a receiver has been appointed, and if a winding up is also underway, that fact must be stated too
  • The company's website and any emails sent to third parties must also carry these statements, with website notices placed in a prominent and easily accessible location
  • "Third party" excludes officers and employees of the company itself, and officers and employees of any holding company or subsidiary
  • Failure to comply with any of these notification requirements is a category 4 offence, potentially affecting the company, its officers, any liquidator, any receiver, or any person acting on the company's behalf
