Hearing of proceedings otherwise than in public

Section 556 allows a court to hold examinership proceedings, in whole or in part, in private where the interests of justice require it, having regard to the interests of the company or its creditors.

  • Examinership proceedings may be heard privately rather than in open court
  • The court may direct that all or only part of the proceedings be held in private
  • The decision must be justified by the interests of justice
  • The court must consider the interests of the company concerned or of its creditors as a whole
