Supplemental provisions in relation to section 558W

Section 558X sets out the practical rules governing proxy instruments used at meetings in the rescue process for small and micro companies, including deadlines for lodging proxies, who may act as proxy, and how proxies are handled for persons with physical disabilities and for corporate creditors.

  • Proxy instruments must be lodged with the process adviser by 4 p.m. on the day before the relevant meeting
  • No minor may be appointed as a general or special proxy
  • Where a creditor or member cannot write due to blindness or other physical disability, their proxy may be accepted if signed or marked in the presence of a witness who certifies the document
  • Where a company is a creditor, an authorised person may complete and sign the proxy on its behalf and appoint themselves as that company's proxy
