Application for confirmation of division by court

Section 500 deals with the court application process required to confirm a division, setting out who must apply and what information must accompany the application.

• All companies involved in a division must make a joint application to the court for an order confirming the division.
• The application must include details of any shareholder who has requested the purchase of their shares under the minority share purchase provisions.
• The size of that shareholder's shareholding must be stated in the application.
• The successor companies must set out the measures they propose to take to comply with the shareholder's purchase request.
