Employee's duty of disclosure

Section 925 sets out the obligations on employees of the Supervisory Authority to disclose any material personal interest in matters being dealt with by the Authority, and the consequences of failing to do so.

  • Employees must disclose to the Supervisory Authority the existence and nature of any material interest they hold in a matter the Authority is dealing with, outside of their role as employee
  • An employee with such an interest must not participate in negotiations, internal deliberations, or recommendations relating to the matter, and must not seek to influence any decision on it
  • These disclosure requirements do not apply to contracts or proposed contracts of employment between the Supervisory Authority and its own employees
  • Where an employee breaches these requirements, the Supervisory Authority may terminate their employment contract or amend their terms and conditions of employment as it sees fit
