Creditors' meetings conducted by electronic means during interim period

Section 690A allows the person responsible for convening a creditors' meeting during the designated interim period to hold that meeting wholly or partly by electronic means, rather than requiring a physical venue, provided all attendees can participate meaningfully.

  • The responsible person may conduct a creditors' meeting entirely or partly through electronic communications technology, removing the obligation to hold it at a physical location, so long as every attendee has a reasonable opportunity to take part.
  • The responsible person must provide or facilitate a suitable electronic platform, including a mechanism for casting votes that does not require physical attendance or the appointment of a proxy.
  • Proportionate requirements and restrictions may be imposed on the use of the technology β€” for example, to verify attendees' identities and ensure security β€” and attendees must be notified of these before the meeting takes place.
  • A temporary or minor failure of the electronic communications technology does not invalidate the meeting or any proceedings connected with it, and the responsible person is not liable for disruptions affecting an attendee's own equipment (unless caused deliberately).
