Offence of acting as process adviser when unqualified

Section 558ZP prohibits a person from acting as a process adviser for an eligible company unless they hold the qualifications required to be appointed as a liquidator, and makes it a criminal offence to do so without such qualification.

  • Only persons qualified under section 633 for appointment as a liquidator of the eligible company may act as a process adviser
  • The qualification requirement applies specifically to the rescue process for small and micro companies under this Part of the Act
  • Acting as a process adviser without the required qualification is a criminal offence (category 2 offence)
  • This provision ensures that companies undergoing the rescue process receive guidance from suitably qualified professionals
