Order in relation to contributory to be conclusive evidence

Section 660 deals with the evidential weight of a court order made against a contributory during a winding up, confirming that such an order serves as conclusive proof of any amounts due and of the facts stated within it.

  • A court order regarding a contributory is conclusive evidence that any money stated as due or ordered to be paid is indeed owed
  • This conclusive status applies unless the order is subject to an appeal that has been or is being pursued
  • All other relevant matters set out in the order are treated as truly and accurately stated
  • The facts stated in the order are treated as true against all persons and in all types of proceedings
