Section 555 requires that certain court orders made during an examinership are publicly notified through publication in the CRO Gazette within a specified timeframe.

  • The examiner (or a court-designated person) must publish a notice in the CRO Gazette confirming delivery of certain orders to the Registrar.
  • The notice must be published within 14 days of the order being delivered to the Registrar.
  • The orders covered are those relating to hearings regarding irregularities (section 533), confirmation of proposals (section 541), and revocation of confirmed proposals (section 553).
  • Failure to comply is a category 4 offence, applying to the person responsible and, where relevant, to the company and any officer in default.
