Extension of interim period

Section 12A provides the Government with the power to extend the interim period introduced during the Covid-19 pandemic, subject to public health and economic considerations and parliamentary oversight.

  • The Government may extend the interim period generally or for specific purposes or provisions, following consultation between the Minister and the Minister for Health.
  • The qualifying conditions for extension relate to the public health threat posed by Covid-19, including its infectious nature and the need to restrict movement, travel and gatherings to limit spread.
  • The requirement to mitigate the economic impacts arising from Covid-19 is also a qualifying condition for extension.
  • Any extension order must be laid before both Houses of the Oireachtas and can be annulled by resolution of either House within 21 days, though such annulment does not affect actions already taken under the order.
