Court may lift restrictions imposed on shares under section 768

Section 771 provides a mechanism for any person aggrieved by the Corporate Enforcement Authority's decision to impose or maintain restrictions on shares to apply to the court to have those restrictions lifted.

  • Any person affected by the Authority's decision to impose restrictions on shares, or its refusal to remove them, may apply to the court for relief
  • The court may lift restrictions where the relevant facts about the shares have been disclosed to the company or the Authority
  • The court may also lift restrictions where it considers it fair to do so, or where it approves a proposed sale of the restricted shares
  • This section does not affect any separate court order maintaining restrictions on shares under section 775
