Non-discrimination, proportionality and transparency of costs

Section 1110E requires intermediaries to be transparent about their fees for shareholder services and prohibits discriminatory pricing between domestic and cross-border services unless the difference reflects genuine cost variations.

  • Intermediaries must publicly disclose any fees they charge for services provided under this chapter.
  • Fees charged for domestic and cross-border services must be the same unless a justified exception applies.
  • A different cross-border fee is only permitted where the fee difference is duly justified and reflects the actual difference in costs incurred.
  • The cost comparison must be between the actual costs of providing the service cross-border and the actual costs of providing it within the State.
