Actions stayed on winding-up order

Section 1347 deals with the automatic stay on legal actions against a company registered under this Chapter once a court order for winding up has been made.

  • Once a winding-up order is made, all legal actions against the company are automatically stayed.
  • No new proceedings may be commenced against the company or any contributory without court permission.
  • Existing proceedings relating to the company's debts cannot continue without leave of the court.
  • Any permission granted by the court may be subject to whatever terms or conditions the court considers appropriate.
