Registrar's notice that document does not comply

Section 898 sets out the Registrar's powers when a document delivered to the Companies Registration Office does not meet the required standards, including the right to reject it and the consequences if a compliant replacement is not provided in time.

• The Registrar has discretion either to serve a non-compliance notice on the person who delivered the document, or to take no action — but silence does not remove any legal consequences of delivering a non-compliant document.
• Any notice served must specify exactly how the document fails to meet the requirements.
• If a notice is served and a compliant replacement document is not received within 14 days, the original document is treated as though it was never delivered at all.
• A non-complying document is one that is required or authorised to be delivered to the Registrar under the Act but fails to meet the relevant requirements of the Act, its regulations, or any other applicable legislation.
