Automatic disqualification on conviction of certain indictable offences

Section 839 deals with the automatic disqualification of persons who are convicted on indictment of certain serious offences relating to companies or involving fraud or dishonesty.

  • A person convicted on indictment of an offence under the Companies Act (or other prescribed enactment) relating to a company, or any offence involving fraud or dishonesty, is automatically disqualified
  • The default disqualification period is 5 years from the date of conviction, but the court may order a shorter or longer period having regard to all the circumstances
  • Either the prosecutor or the disqualified person may apply to the court to vary the period of disqualification
  • This automatic disqualification operates in addition to any other disqualification provisions elsewhere in the Act
