Restriction of application of certain articles of Data Protection Regulation

Section 944R restricts certain data protection rights of individuals where necessary to allow the Corporate Enforcement Authority to carry out its investigative and enforcement functions effectively.

  • Two specific GDPR rights are restricted: the right to be informed when personal data has been collected indirectly (Article 14) and the right of individuals to access their personal data (Article 15).
  • These restrictions apply only to the extent that they are necessary and proportionate to safeguard the Authority's effective performance of its functions under section 944D(1)(b) and (e).
  • The restrictions are limited to situations where the Authority's functions give rise to the processing of personal data that falls within the scope of the GDPR.
  • The "Data Protection Regulation" referred to is Regulation (EU) 2016/679, commonly known as the General Data Protection Regulation (GDPR), which replaced the earlier Directive 95/46/EC.
