Striking off (involuntary and voluntary cases) and dissolution

Section 733 describes the act of striking a company off the register by the Registrar, covering both involuntary and voluntary cases, and establishes the point at which a company is deemed to be dissolved.

  • In involuntary cases, the Registrar may strike a company off the register if the required remedial step has not been taken by the deadline specified in the notice issued under section 730.
  • In voluntary cases, the Registrar may strike a company off the register if no valid objection has been received within the notice period and the company has not requested cancellation of the strike-off process.
  • The Registrar must publish a notice of the striking off in the CRO Gazette.
  • The company is dissolved on the date the strike-off notice is published in the CRO Gazette, and this date is formally referred to as the "date of dissolution".
