Appeals to and orders of court, including orders confirming decisions of Authority

Section 944AH sets out the court's powers when hearing appeals against decisions of the Corporate Enforcement Authority regarding sanctions imposed on directors of public interest entities, and the requirement for court confirmation before such sanctions take effect.

• The court may consider any evidence or arguments on appeal, including material not previously put before the Authority.
• The court may confirm, modify, or annul the Authority's decision under appeal.
• A sanction imposed on a relevant director does not take effect until confirmed by the court, either on appeal or on application by the Authority.
• The court may also make any order it sees fit to compel compliance with a settlement agreement reached under the relevant provisions.
