Meaning of court

Section 743 clarifies the meaning of "court" for the purposes of court-based restoration applications and specifies which Circuit Court has jurisdiction depending on the applicant and circumstances.

  • For restoration applications by a creditor or the Registrar, "court" means either the High Court or the Circuit Court
  • A creditor applying to the Circuit Court must generally apply in the circuit where the company's registered office was located before strike-off
  • If there was no registered office, the creditor applies in the circuit where they reside, or to the Dublin Circuit if they live outside the State
  • Applications by the Registrar to the Circuit Court must always be made to the Dublin Circuit
