Publication of relevant sanction imposed on relevant director

Section 944AE requires the Corporate Enforcement Authority to publish details of sanctions imposed on directors of public interest entities, subject to certain anonymity and appeal provisions.

  • The Authority must publish on its website the details of any contravention, conduct, sanction and director involved, promptly after court confirmation or court-imposed sanction
  • Where an appeal is lodged, the Authority must update its website with the status or outcome of that appeal as soon as practicable
  • Publication may be made on an anonymous basis where it would be disproportionate regarding personal data, could jeopardise financial market stability or a criminal investigation, or could cause disproportionate damage to the director
  • Published details must remain on the Authority's website for at least five years, and must also be notified to the Supervisory Authority
