Powers of court cumulative

Section 565 confirms that the powers granted to the court under the Companies Act 2014 are cumulative and do not replace or limit any pre-existing powers the court already holds.

  • Powers conferred on the court by the Act are additional to any existing court powers
  • The Act does not restrict or diminish any powers the court already possesses
  • The court retains its existing ability to institute proceedings against contributories, debtors, or their estates
  • Recovery actions for calls or other sums owed to the company remain fully available under both existing and new powers
