Restriction of this Chapter

Section 1327 establishes that the provisions in this Chapter governing the winding up of unregistered companies are subordinate to certain chapters of the EU Insolvency Regulation.

  • This Chapter on winding up of unregistered companies does not operate in isolation
  • It is subject to the general provisions set out in Chapter I of the EU Insolvency Regulation
  • It is also subject to the rules on secondary insolvency proceedings in Chapter III of the same Regulation
  • Where any conflict arises, the EU Insolvency Regulation takes precedence over this Chapter
