Proxies

Section 558W sets out the rules governing the use of proxies when the process adviser of an eligible company calls a meeting of its members and creditors under the rescue process for small and micro companies.

  • Members and creditors may vote in person or appoint a proxy to vote on their behalf at the meeting.
  • Any proxy appointment must be made using the prescribed form.
  • A special proxy may be appointed to vote at the meeting or any adjournment, while a general proxy may also be appointed subject to certain restrictions.
  • The process adviser may be appointed by a member or creditor to act as either a general or special proxy.
