Acting Member

Section 944I sets out the arrangements for appointing an acting member of the Corporate Enforcement Authority when the regular member or chairperson is unavailable or when a vacancy arises.

  • Where only one member is in post and is absent or unable to act, the Minister may authorise a person (including a staff member of the Authority) to perform the functions of both member and chairperson.
  • Where a vacancy exists in both the member and chairperson positions and no member is currently appointed, the Minister may authorise a person to perform the member's functions for the duration of the vacancy.
  • A vacancy-related authorisation is limited to six months, but the Minister may extend it if a permanent appointment is not practicable within that period.
  • The Minister may terminate any such authorisation at any time, and the authorised person may exercise all functions of a member and chairperson, with certain limited exceptions relating to formal appointment, removal and superannuation provisions.
