Provision as to names of companies formed pursuant to statute

Section 1446 provides that certain companies originally incorporated under older legislation, which were not required to include "limited" or equivalent words in their name, can continue to enjoy that exemption under the Companies Act 2014.

  • Applies to companies incorporated under former companies legislation in compliance with a requirement of any statute
  • The relevant statute must have exempted the company from including "limited", "teoranta", "public limited company", or "cuideachta phoiblΓ­ theoranta" in its name
  • Such companies are not required to add prescribed name endings, even though they continue in existence under a particular Part of the 2014 Act
  • The exemption is preserved even if the company re-registers as a designated activity company under Chapter 6 of Part 2
