Court may grant exemption from requirements of disclosure order

Section 810 deals with the court's power to exempt certain persons or interests from the requirements of a disclosure order, and the conditions that must be met before such an exemption can be granted.

  • When making a disclosure order, the court may exempt specific persons, groups, or classes of persons from all or part of the order's requirements.
  • Exemptions may also apply to particular interests, shares, or debentures, including specific groups or classes of these.
  • An exemption may only be granted where the court considers it just and equitable to do so.
  • The court must also be satisfied that the financial interest of the person who applied for the disclosure order will not be prejudiced by granting the exemption.
