Actions against company stayed on winding-up order

Section 678 deals with the automatic stay on legal actions and proceedings against a company once a winding-up process has commenced.

• Once a winding-up order is made, a provisional liquidator is appointed, or a voluntary winding-up resolution is passed, all legal actions against the company are automatically stayed
• No new proceedings may be commenced against the company without the permission of the court
• Where the court does grant permission, it may attach whatever conditions it considers appropriate
• Proceedings before the Workplace Relations Commission are exempt from this restriction and may continue regardless
