Meaning of "disqualified" and "disqualification order"

Section 838 defines the terms "disqualified" and "disqualification order" as used in Chapter 4 of Part 14 of the Companies Act 2014.

  • A disqualification order is a court order that prohibits a person from holding certain roles or engaging in certain activities related to companies and other specified entities.
  • A disqualified person is banned from being appointed or acting as a director, officer, statutory auditor, receiver, liquidator, or examiner.
  • The disqualification also prevents a person from being involved, directly or indirectly, in the promotion, formation, or management of any company, friendly society, or industrial and provident society.
  • The scope of the disqualification extends beyond companies to include friendly societies under the Friendly Societies Acts 1896 to 2014 and societies registered under the Industrial and Provident Societies Acts 1893 to 2014.
