Removal, cessation or disqualification of Director

Section 947 sets out the circumstances under which the Director of Corporate Enforcement may be removed from office, must cease to hold office, or is disqualified from appointment. Note: this section has been repealed by the Companies (Corporate Enforcement Authority) Act 2021.

  • The Minister has the power to remove the Director of Corporate Enforcement at any time, but only for specific stated reasons.
  • The Director must cease to hold office automatically upon entering or being nominated for certain political positions.
  • Holders of certain political positions are disqualified from being appointed as the Director of Corporate Enforcement.
  • This section was repealed by section 3 of the Companies (Corporate Enforcement Authority) Act 2021, which replaced the individual Director role with the Corporate Enforcement Authority.
