Content of examiner's report

Section 536 sets out the mandatory contents that must be included in an examiner's report to the court following the conclusion of the required meetings with creditors and members.

  • The report must include the proposals presented at meetings, any modifications adopted, and the outcome of each meeting
  • A full statement of the company's assets and liabilities (including contingent and prospective liabilities) as at the report date must be provided
  • A detailed list of all creditors is required, showing amounts owed, the nature and value of any security held, and the priority ranking of each creditor
  • The examiner must include their own recommendations, a list of officers, any creditors' committee recommendations, and any other matters they consider appropriate or the court directs
